These Terms of Use (hereinafter "the ToU") govern access to and use of the FlixBag platform (hereinafter "the Platform"), accessible via the mobile application (iOS and Android) and website www.flixbag.com, published by FlixBag company, SASU with capital of 1000 euros, registered in the RCS of Bourg-la-Reine under number [RCS], whose registered office is located at 53 rue Hoffmann, 92340 Bourg-la-Reine.
FlixBag is a matching platform between travelers with excess luggage kilograms and senders wishing to ship packages internationally at competitive rates. The Platform ensures intermediation, transaction security and shipment logistics tracking.
Any registration or use of the Platform implies unreserved acceptance of these ToU in their entirety. If you do not accept these conditions, you are requested not to use the Platform.
The terms below, when used with a capital letter, have the following meaning:
These ToU aim to define the conditions of access, registration and use of the FlixBag Platform, as well as the respective rights and obligations of FlixBag and its Users within the framework of services offered, namely: matching between Travelers and Senders, package transport transaction management, dynamic pricing, logistics tracking, dispute management and ancillary services.
Platform registration is reserved for adults (18 years old or age of majority in their country of residence) with full legal capacity. Users declare and guarantee accuracy of information provided during registration.
Registration requires providing the following information: surname, first name, email address, phone number, postal address, and creation of a secure password. Users will receive a confirmation email to validate their account.
Travelers must undergo identity verification via passport scan. A verification badge is awarded after validation. This badge is an essential prerequisite for publishing any listing on the Platform.
Users are solely responsible for confidentiality of their login credentials. Any activity performed from their account is deemed performed by them. In case of suspected fraudulent use, Users must immediately inform FlixBag.
FlixBag acts as a technical intermediary matching Travelers with excess kilograms and Senders wishing to ship packages. FlixBag is not a party to the transport contract between Sender and Traveler.
Senders fill out a form indicating package type, weight, category (Standard or Premium), shipping location, destination and Recipient details. The Platform's algorithm proposes up to approximately three Traveler options, ranked by increasing price, with display of their star rating and status. Senders choose a Traveler and proceed to full payment, which is escrowed by FlixBag until effective delivery.
Travelers create a listing by entering their flight details (electronic ticket upload for verification), number of available kilograms and package reception preferences. Kilogram price is automatically calculated by the Smart-Pricing algorithm — Travelers set no price. Once sale is notified, Travelers receive the package according to agreed terms.
Pricing is fully automated and managed by FlixBag's algorithm. Total price includes base kilogram price (calculated based on ticket price and purchase date), multiplier coefficient related to product category (Standard: 1x, Premium: 1.5x) and FlixBag Commission. No User can modify prices displayed by the Platform.
Delivery is performed according to one method: hand delivery (meeting between Traveler and Recipient with photographic identity verification via application). Effective delivery triggers payment to Traveler after entering 4-digit code provided by Recipient.
Sort-Bag allows Travelers to organize suitcase contents (hold and cabin) via lists with priority tags and automatic reminders (24h and 6h before flight). The feature automatically suggests selling remaining kilograms.
FlixBag accepts the following payment methods: credit card (Visa, Mastercard), Apple Pay, Google Pay, KKiaPay, FedaPay, PayDunya and CinetPay. Payment providers are selected to ensure Platform's international geographic coverage.
Total amount paid by Sender is escrowed by FlixBag until effective delivery confirmation. Payment is automatically released to Traveler upon effective package delivery (hand delivery) and entry of 4-digit confirmation code.
FlixBag collects a commission on each Transaction, included in total price displayed to Sender. Commission amount is transparent and detailed in Transaction summary before payment validation.
Full refund to Sender. Traveler is downgraded one point in ranking system.
Refund of 70% of amount paid to Sender.
Traveler returns package via return label. Sender is refunded 50% of initial amount (fees applied).
Three new Traveler proposals are submitted to Sender. Otherwise, full refund to Sender. Traveler is downgraded one point.
In case of flight delay, no penalty applies. In case of flight cancellation, Sender is fully refunded if requesting package return.
Differentiated penalties apply depending on cancellation delay relative to flight date: between 3 and 5 days before flight (moderate penalties), between 1 and 2 days before flight (increased penalties), day of flight (maximum penalties). Precise amounts are detailed in pricing schedule annexed to ToU.
At the end of each Transaction, a satisfaction survey is sent to parties. Traveler rates Sender and FlixBag service; Sender rates Traveler and FlixBag service. Ratings are public and visible to other Users.
Each User has a ranking from 1 (elite) to 5 (default). Default ranking is 5 for any new User. Ranking is improved through regular use and good ratings, and degraded in case of cancellation attributable to User (downgrade one point per cancellation). Platform algorithm considers ranking for Traveler proposal order.
"Regular" status is automatically awarded when a Traveler publishes at least one listing per month for three consecutive months, or at least three listings in the same month. This status is visible on profile and constitutes a reliability guarantee.
If package weight received by Traveler exceeds announced weight by more than 150 grams, Traveler can report discrepancy (photo evidence). Sender then has option to pay supplement or request package return.
If delivery has not been made, Traveler can choose "Deliver later" (with Sender's agreement) or "File dispute". Automatic notifications are sent 1h and 2h after flight end if deposit is not confirmed.
If Recipient notes package weight or quality non-conformity, they can file a dispute via Platform.
In case of litigation, concerned Traveler's profile is deactivated until resolution. No payment is made to Traveler during litigation duration. Sender is fully refunded.
In case of difficulty obtaining 4-digit confirmation code, Traveler can contact FlixBag customer service, which will proceed with manual validation (phone call, photographic verification of Recipient's identity).
Users commit to providing accurate, complete and up-to-date information, using Platform according to its intended purpose and these ToU, not using Platform for illegal, fraudulent purposes or infringing third party rights, and respecting applicable laws and regulations regarding transport, customs and import/export.
Travelers commit to transporting only packages compliant with air and customs regulations, verifying package contents before transport (right to refuse in case of doubt), respecting agreed delivery deadlines, and not opening, altering or substituting package contents.
Senders commit to declaring exact nature and actual package weight, not sending prohibited, dangerous, illegal or counterfeit products, respecting destination country customs restrictions, and properly packaging packages to ensure their integrity.
Strictly prohibited from transport via FlixBag: dangerous, flammable, explosive or toxic substances, narcotics and psychotropic substances, weapons and ammunition, counterfeit products, protected species and products violating CITES, undeclared currencies and precious metals, and any product whose transport is prohibited by legislation of origin, transit or destination country.
FlixBag acts as a technical intermediary and is not a party to transport contract concluded between Sender and Traveler. FlixBag cannot be held responsible for Users' acts, omissions, delays or failures in performing their mutual obligations.
FlixBag cannot be held responsible for indirect damages (profit loss, data loss, image prejudice) resulting from Platform use. FlixBag's liability is strictly limited to commission amount collected for disputed Transaction.
FlixBag cannot be held responsible for any delay or non-performance resulting from force majeure as defined by applicable law, including natural disasters, pandemics, strikes, network failures and government decisions.
All Platform elements (design, logos, trademarks, texts, images, algorithms, source code, databases) are exclusive property of FlixBag and are protected by French and international laws relating to intellectual property.
Any reproduction, representation, modification, publication, transmission, distortion, total or partial, of Platform or its content, by any process whatsoever, without express and prior authorization from FlixBag, is strictly prohibited and constitutes counterfeiting sanctioned by Articles L.335-2 et seq. of Intellectual Property Code.
FlixBag reserves the right to temporarily suspend User's Platform access in case of: violation of these ToU, suspicion of fraud or illegal activity, ongoing litigation, or behavior harming other Users' security.
Users can terminate their account at any time by sending request to customer service or via account settings. Termination takes effect after completion of any ongoing Transaction. Personal data is processed in accordance with Privacy Policy.
In case of serious or repeated breach of ToU, FlixBag reserves the right to definitively terminate User's account with immediate effect, without prejudice to any damages.
FlixBag strongly recommends Senders subscribe package insurance for valuable shipments. FlixBag is not an insurer and does not guarantee integrity of transported packages. However, FlixBag commits to facilitating dispute resolution and applying refund procedures provided in these ToU.
Processing of Users' personal data is governed by FlixBag's Privacy Policy, accessible on Platform and constituting integral part of these ToU.
FlixBag reserves the right to modify these ToU at any time. Modifications are notified to Users by email and/or in-app notification at least thirty (30) days before their effective date. Continued Platform use after modified ToU take effect constitutes acceptance of new conditions.
These ToU are governed by French law, without prejudice to mandatory provisions of User's country of residence law when User has consumer status.
In case of dispute, parties commit to seeking amicable solution within thirty (30) days. Users can also resort to consumer mediation in accordance with Articles L.611-1 et seq. of Consumer Code.
In accordance with Article 14 of Regulation (EU) No. 524/2013, European Users can access European online dispute resolution platform at: https://ec.europa.eu/consumers/odr
In absence of amicable resolution, any dispute will be submitted to competent courts of France, subject to mandatory jurisdiction rules applicable to consumers.
If one or more provisions of these ToU are deemed invalid or declared as such pursuant to law, regulation or final decision of competent court, other provisions will retain full force and effect.
FlixBag's failure to enforce User's breach of any ToU provisions cannot be interpreted as waiver of provision in question.
These ToU, Privacy Policy and Legal Notices constitute entire agreement between User and FlixBag.
